After a slip and fall: five steps

Tap a step to open it. You don’t need to do everything at once.

Get medical attention, even if the injury seems minor, because some injuries only show up later. If you can, move away from the hazard so no one else falls.
Tell the owner or manager what happened and ask for a written incident report. Keep a copy if you can.
Photograph what caused the fall, such as a wet floor, uneven surface or poor lighting, plus the surrounding area, your footwear and your injuries. Note the date and time.
Ask anyone who saw the fall for their name and contact information. Avoid guessing about what caused it or who was at fault.
Save bills and reports. Think before giving a recorded statement or accepting an offer. A free case review can help you understand your options.

Frequently asked questions

What makes a property owner responsible for my fall?

Generally, an owner may be responsible if they knew or should have known about a hazard and failed to fix it or warn visitors within a reasonable time.

Does it matter if there was a warning sign?

It can. Whether a warning was adequate, and whether the hazard should have been fixed regardless, are both relevant factors in these cases.

Do I have to pay anything to submit an inquiry?

No. Submitting your information through InjuryXperts is free and comes with no obligation.

Is InjuryXperts a law firm?
